1. This promotional campaign is organised by Ascendis Consumer Brands or its nominee (hereinafter referred to as ”the Promoter”).
  2. The provisions of this promotional campaign are governed by the terms set out in section 36 of the Consumer Protection Act 68 of 2008 (hereinafter referred to as the “Act”), together with accompanying regulations.
  3. Please contact us on [email protected] if you do not understand any part of these rules or if you have any questions about these rules or this promotional campaign. By entering this promotional campaign, you confirm that you have read and agree to be legally bound to these rules.
  4. The promotional campaign is open to permanent residents of South Africa over the age of 18 years except any employee, director, member, partner, agent or consultant or any person directly or indirectly who controls or is controlled by the Promoter.
  5. By entering into the promotional campaign, all participants, including the winner/s, agree to be bound by these rules, which will be interpreted by the Promoter, whose decision regarding the winner/s or any dispute associated therewith will be final and binding. The Promoter reserves the right to amend, modify, change, postpone, suspend or cancel this promotional campaign and associated Prize (should the Prize have not yet been determined by the Promoter), or any aspect thereof, without notice, at any time, for any reason which the Promoter reasonably deems necessary.
  6. The promotional campaign commences on 1 November 2019 and ends on 31 January 2020, both days inclusive. Nominations, as defined below, received after the closing date, will not be taken into consideration.
  7. The Promoter reserves the right, in its sole discretion, to extend the duration of this promotional campaign.
  8. All nominations must be women in South Africa over the age of 18 years.
  9. Nominees stand a chance to win the following:
    1. Ten nominees will be chosen by the Promoters team and their stories will feature on the Woman to the Bone microsite and MenaCal.7 social media pages, Twitter, Instagram and Facebook;
    2. Of ten nominees chosen per paragraph a above, three winners will be selected by the Promoters team to win a R20 000 (twenty thousand) cash prize to be used to further their purposeful work in their communities
    3. The top three winners will be featured in the April 2020 editions of Sarie and Fairlady magazine, as well as on the Woman to the Bone microsite and MenaCal.7 social media pages.
    4. (hereinafter referred to as “the Prize”).
  10. By nominating a woman, participants agree to receive future communication from the Promoter.
  11. For a nominee to be eligible for the Prize, nominations must be made of potential women by  completing the nomination form at https://xd.adobe.com/view/2534a67e-6ce2-4f30-58e2-050311c89686-5305/ [email protected] (hereinafter referred to as “the Entry”).
  12. The winner will be chosen at the discretion of the Promoter.
  13. Participations that do any of the following or attempt to do any of the following, whether alone or through anyone else will immediately be disqualified from this promotional campaign:
    1. Manipulating the promotional campaign in any way; and
    2. Providing false, misleading or otherwise incorrect information.
  14. The winner/s will be announced on the 25th March 2019 and will be called telephonically to be notified of same.  The Promoter’s decision will remain final and binding.
  15. The winner/s will be required to provide her proof of identity, and to verify that they are above the age of 18.
  16. The Prize is non-transferable, and no cash alternatives are available, where the Prize does not compile of cash.
  17. The Winner/s will have 3 (three) calendar months to claim their Prize, failing which, the Prize will be reallocated at random.
  18. All participants, including the Winner/s, indemnify the Promoter, its advertising agencies, advisers, nominated agents, suppliers, its affiliates and/or associated companies against any and all claims of any nature whatsoever, whether in contract, delict or otherwise, arising out of and/or from their participation in any way in this promotional campaign (including, as a result of any act or omission, whether as a result of negligence, misrepresentation, misconduct or otherwise on the part of the Promoter) and/or use of the Prize.
  19. The names of the Prize Winner/s will be published on the  Woman to the Bone microsite and MenaCal.7 social media pages, Twitter and Instagram accounts and will feature in the April 2020 editions of Sarie and Fairlady magazines.
  20. The Winner/s may be required to take part in the Promoter’s and/or the Prize sponsor’s publicity campaigns or to allow her name and likeness to be used by the Promoter and/or the Prize sponsor for promotional purposes.
  21. Apart from the exceptions as set out above, all personal information of participants shall be treated in accordance with Promoter’s Privacy Policy.
  22. No Entries from agents, third parties, organised groups or applications automatically generated by computer or any other means, will be accepted, and such conduct shall constitute an unlawful manipulation of the campaign in accordance with the rules set out herein. No incomplete or corrupted Entries will be accepted. Entries will only be accepted if they comply with all rules set out herein.
  23. Responsibility is not accepted for Entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind.
  24. In addition to the Prize a donation will be made as follows:
    1. For every MenaCal.7 bone health product sold, R2 will be donated to women upliftment in association with The Clothing Bank (“Donation”);
    2. Donations will commence on 1 November 2019 and end on 30 June  2020;
    3. All MenaCal.7 bone health products are subject to the R2 donation for the period stipulated above (even if they do not have the R2 sticker located on them).
  25. Participants are responsible for any data, mobile phone or any other charges necessary to enable participants to gain the necessary network or internet access to be able to enter this promotional campaign.
  26. The clauses in these rules are severable. This means that if any clause in these rules is found to be unlawful, invalid or for any reason unenforceable, it will be removed and the remaining clauses will remain in full force and effect.
  27. These rules and this promotional campaign are governed by the law of the Republic of South Africa.
